TERMS AND CONDITIONS
These Terms and Conditions apply to products, treatments, appointments, events, courses and workshops supplied by EarthSpirit Healing Gardens.
By placing an order, making a booking or paying for any product or service, you confirm that you have read and accepted these Terms and Conditions.
1. Business Information
EarthSpirit Healing Gardens

Stalybridge

United Kingdom
Telephone: 07414 898698
Website:

2. Products and Online Orders
All products are subject to availability. We reserve the right to withdraw a product, correct an error or refuse an order where necessary.
Product photographs and descriptions are provided as accurately as reasonably possible. Crystals, minerals and handmade products are naturally unique. Colours, markings, shapes, sizes and finishes may therefore vary slightly from photographs.
An order is not accepted until payment has been received and the order has been confirmed.
3. Prices and Payment
All prices are shown in pounds sterling. Full payment is required when placing an online order or booking a treatment, event, course or workshop.
Prices may change without notice, but changes will not affect orders or bookings already confirmed.
4. Delivery and Collection
Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control.
Customers choosing collection are responsible for collecting their order during the agreed collection period. Proof of purchase may be requested.
Risk in a product passes to the customer when it is delivered or collected.
5. Returns and Refunds for Products
Nothing in these Terms and Conditions affects your statutory consumer rights.
Customers purchasing products online normally have the right to notify us that they wish to cancel within 14 days of receiving their order. After notifying us, the goods must be returned within a further 14 days.
Returned products must be unused, handled only as reasonably necessary to examine them and returned securely in their original condition where possible. Customers are responsible for return postage unless the product is faulty, damaged or incorrectly supplied.
We may make a reasonable deduction where a returned product has been used, damaged or handled beyond what would reasonably be permitted in a physical shop.
Certain items may not be returned for a change-of-mind refund where a legal exception applies, including:
- Bespoke, personalised or commissioned products
- Sealed goods that are not suitable for return for health or hygiene reasons once unsealed
- Products that have been inseparably mixed with other items after delivery
Products purchased in our physical shop are not automatically refundable because the customer has changed their mind. Any discretionary exchange or credit offered by us does not affect the customer’s rights where an item is faulty.
6. Faulty, Damaged or Incorrect Products
Please contact us as soon as reasonably possible if a product arrives faulty, damaged or incorrect. We may request photographs and order information so that we can investigate.
Where legally required, we will provide an appropriate repair, replacement or refund. Your statutory rights are not affected.
7. Treatments and Appointments
Treatments and appointments are personal services for which time, preparation and facilities are reserved specifically for the customer. Full payment is therefore required when booking.
Please provide at least 48 hours’ notice if you need to cancel or rearrange an appointment.
Where less than 48 hours’ notice is given, or the customer does not attend, some or all of the booking fee may be retained to cover the time reserved, preparation undertaken and losses reasonably incurred.
Where sufficient notice is provided, we may offer an alternative appointment or credit at our discretion, subject to availability.
Any cancellation charge will be reasonable and will not exceed the loss caused by the cancellation.
8. Events, Courses and Workshops
Places at events, courses and workshops must be paid for in full when booking.
Bookings are made for a particular person, date and limited place. Once confirmed, event, course and workshop fees are non-refundable if the customer changes their mind or is unable to attend, except where cancellation rights apply by law.
With reasonable notice, we may allow the customer to transfer their place to another person or move it to another suitable date. Any transfer is subject to our prior agreement and availability.
Failure to attend does not create an entitlement to a refund, credit or transfer.
Where a course includes several sessions, missed sessions are not refundable. We cannot guarantee that a missed session can be repeated or transferred.
9. Treatments, Workshops and Personal Responsibility
Treatments, spiritual practices, energy work, meditations, sound experiences and workshops are intended to support personal wellbeing, relaxation, education and spiritual exploration.
They are not a replacement for medical diagnosis, medical treatment, psychotherapy or professional healthcare advice.
Customers must disclose any relevant medical condition, pregnancy, injury, allergy, medication, accessibility requirement or other matter that could affect their safe participation.
Customers remain responsible for deciding whether a treatment or activity is suitable for them. Where appropriate, they should seek advice from a qualified healthcare professional before participating.
We may refuse or stop a treatment or activity where we reasonably believe that continuing would be unsafe or inappropriate.
No particular physical, emotional, spiritual or financial outcome is promised or guaranteed.
10. Late Arrival
Customers should arrive at the stated time. Late arrival may result in a shortened treatment or missed activity so that later bookings are not disrupted.
The full fee will remain payable where the reserved time cannot reasonably be extended.
11. Conduct
We reserve the right to refuse admission or end a treatment, event or workshop where someone behaves abusively, disruptively, inappropriately or in a way that risks the safety or wellbeing of others.
A refund will not normally be provided where participation is ended because of the customer’s conduct.
12. Cancellation by EarthSpirit Healing Gardens
Occasionally, we may need to cancel or rearrange an appointment, event, course or workshop due to illness, insufficient attendance, venue problems or circumstances outside our reasonable control.
Where we cancel, customers will be offered a replacement date, credit or refund of the amount paid for the cancelled service.
We are not responsible for separate costs incurred by the customer, such as travel or accommodation, except where liability cannot legally be excluded.
13. Liability
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or breach of statutory consumer rights.
Subject to the above, we are not responsible for losses that were not reasonably foreseeable when the order or booking was made.
14. Changes to These Terms
We may update these Terms and Conditions occasionally. The terms applying to an order or booking will be those in effect when it was confirmed.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Customers retain any mandatory rights they have under applicable consumer law.
16. Contact
Questions, cancellations and concerns should be directed to EarthSpirit Healing Gardens using the telephone number or contact form shown on our website.

This is a strong practical draft, but because it governs customer contracts, I recommend having it checked by your local Trading Standards service or a UK solicitor before publishing it.
